The single biggest source of confusion for foreign property buyers in Thailand is the difference between freehold and leasehold ownership.
Freehold Ownership
- What you own: Full ownership of the unit — your name on the title deed
- Who qualifies: Condominium units only (within 49% foreign quota)
- Duration: Perpetual — inheritable by your heirs
Leasehold Ownership
- What you own: A registered leasehold right at the Land Office
- Common for: Houses, villas, land, and condos past their foreign quota
- Standard term: 30 years with renewal options (30+30+30 common)
Which One Should You Choose?
Choose freehold if: Buying a condo with quota remaining, want maximum resale flexibility.
Choose leasehold if: Buying a house or villa (land ownership isn't an option), or the foreign quota is full.
Warning: Never accept a "guaranteed" nominee structure where a Thai person holds shares on your behalf — this is illegal.
